The Divorce Mediation Process in Texas

What Is Estate Planning?

TEXAS DIVORCE MEDIATION EXPERTSEstate planning entails determining your values, aspirations, and vision for your and your loved ones’ futures. Estate Planning will also entail working closely with your skilled estate planning attorneys to develop a framework for advancing your values and realizing your defined goals and vision.

After your plan is developed, you may also continue to work closely with your lawyer to keep an eye on the plan to make sure it stays current and relevant as your life, circumstances, and the applicable laws change.

Houston Probate Lawyer & Estate Planning

An estate planning lawyer has a wide range of tools at his or her disposal. Because no two clients have the same values, goals, or vision, each estate plan is a one-of-a-kind development by the client, with the assistance of their estate planning attorney, CPA, financial advisor, and perhaps others.

Our estate planning attorneys’ main goal is to give you peace of mind, knowing that your legacy will benefit your beneficiaries rather than cause them troubles. This could include ensuring that minor children are cared for according to your wishes, charitable planning, business succession planning, income/estate/gift tax planning, and asset protection in the event of divorce, disability, addiction, bankruptcy, lawsuits, and the multitude of other problems that surround families who fail to plan properly.

Texas Law and Estate Planning

Houston Estate Planning AttorneyEstate planning is commonly linked to state law, and Texas has its own estate planning legislation.

Texas, unlike many other states, has no estate or inheritance taxes, while there is a federal tax on extremely high-value estates.

Certain planning issues can be substantially reduced as a result of this.

Finally, it’s worth noting that common-law spouses, as well as adopted and illegitimate children, have the same inheritance rights as legally married and related spouses and children in Texas.

These are just a few of the complexities in Texas estate law that can have an impact on your estate planning. Our wills and estates attorneys have the knowledge of both state and federal law to assist you in drafting a thorough and legally sound estate plan.

Secure Your Legacy with a Legally Valid Will

A will is more than a simple document—it’s a legal tool that ensures your assets are distributed according to your wishes. While online templates may seem convenient, an improperly drafted or executed will can be challenged in probate court, leading to delays, disputes, and unintended outcomes.

I personally cannot say enough about how impressed and beyond grateful I am, as well as my family, to Mr. Bayley. He has proven himself time and time again to be both honest and dedicated as an attorney and as a genuinely good person. As a client I feel completely comfortable and assured that he has and continues to do the best job possible to represent my case and I have since recommended (and will continue to do so) his services to anyone needing representation. -Read More on Google Review Page.

I can’t say enough good things about Andrew. I remember the first time we spoke and the consultation we had and how refreshing it was to feel like I was talking to someone that truly cared about my legal situation and showed compassion. Opposed to the numerous consultations I had had prior with trust and estate attorneys that I just felt hopeless talking to. I’m so thankful for not only the compassion but also the honesty during our initial talk. He wasn’t telling me what I wanted to hear but more so telling me what expectations I should have based on which route I was to choose. –Read More Here.

Texas Probate & Estate Planning FAQ

What's the going rate for estate planning?
The answer to this question will depend on how large and complex your estate is. Many clients have a simple estate and just want to make sure their assets easily pass to their loved ones. We can certainly help with that. Some clients have several investments, off-shore and on-shore, real estate, an on-going business, mineral rights, and more. This would be considered a more complex estate and may incur higher costs than a simple estate. The best thing to do is call our office and speak to one of our estate planning attorneys to get a cost estimate.
Should I hire an estate planning attorney or probate lawyer?
Most estate planning attorneys can also handle probate issues. Typically we think of estate planning when we are created a Will or Trust and deciding how our assets will pass to our remaining family. On the other hand, we typically probate an estate in probate court after our beloved one has passed. In either case, you can call our office to speak to an attorney who will help you determine how best to proceed.
How much does a Will cost in Texas?
As always, it depends on the complexity and size of your estate. A large and complex estate may incur higher costs in developing a Will than a simple and small estate. And there is also a chance that a Will may not even be the best vehicle for your estate. It is possible that a Trust, or other testamentary vehicle, may be the better option for your specific situation. In certain instances, a Trust could help your family save on taxes, and may end up being more cost effective than a Will in the long run. Again, this is a difficult question to answer accurately without knowing the particulars of your specific situation. So if you call our office, one of our estate planning attorneys can help you get an accurate assessment of the costs involved in creating a Will or estate plan in Texas.
